Verified Reviewer | Denver, ColoradoFailure to Represent Potential Buyer Under Transaction Broker Agreement
On February 27th, my spouse and I asked to tour a Vivi Team re-listing in the Baker neighborhood of Denver. We had asked about this property while touring a different Vivi Team open house the week before and learned that it had been pulled from the market due to issues with some repair work.
Although we were somewhat concerned with inconsistencies we heard from Vivi Team members, we very much liked the property and informed the agent Vivi Gloriod of our intent to submit an offer.
Later that day, we submitted an offer via email to buy the property at full price. We ultimately did not purchase this home.
Does this review stem from "sour grapes"? You decide based on the following facts:
1. On February 28th, Vivi contacted us asking if we intended to submit an offer.
We directed Vivi to our offer sitting in her email inbox.
2. At Vivi's suggestion, we agreed to sign an EXCLUSIVE RIGHT-TO-BUY LISTING CONTRACT with Homesmart Vivi Team under which Homesmart would act as "transaction-brokerage". Under section 5, among other broker duties, Vivi was required to "facilitate purchase transactions without being an advocate or agent for either party" and keep "Buyer fully informed regarding the transaction".
3. Team Vivi revised our offer in order to become a transaction broker and on Feb 28 we submitted a second offer at full price.
Vivi revised a number of terms critical to us which had to negotiate back into the offer.
4. The first and second offers were drafted to expire at 5PM on the 28th. At Vivi's urging, we extended the review period to noon on March 1.
5. We heard nothing on or before noon on 3/1.
Later that day we called Vivi, and based on that conversation, we issued a third offer this time exceeding list price set to expire 4:00PM 3/1.
6. We heard nothing the rest of the day or since our submission of the third offer. Our assumption is that our offer was surpassed by another.
7. We learned from Zillow on 3/2 that this home has a "pending offer".
Our assumption is that Vivi worked and communicated with the seller in order to accept an alternative offer. We were not kept informed.
8. Ironically, we were prepared to increase our offer. Had Vivi contacted us, we were in a position to submit a fourth offer.
Vivi in effect did a disservice to the seller as well as us.
We assume Vivi leveraged our offers to increase the selling price offered by another buyer.
This is advantageous to the seller but not illegal. We certainly understand how real estate transactions work.
However, we cannot recommend Vivi Team based on the lack of representation, lack of communication and lack of transparency we experienced.

I was moving in my new home and I needed some furniture and I never used rental center before and I saw the perfect bedroom suit. I came in and he gave me price I received application and I brought it back he said he would verify everything and it would be delivered Friday.
I came in the price he quoted me was wrong and he corrected it and I told him I will let my finance look it over and I will be back Friday. We came in and they went over everything and he said my furniture would not be delivered because he haven't verified my information but he told me everything was complete. I told him to cancel my order because I was moving in today and I need my furniture. He became rude and unprofessional and started fussing.
My fiancé told him that he can't talk to me that way he started at my fiancé and started bringing up old issues and accounts that he had with them in past which I wasn't aware of which was confidential information between you all and customer which had nothing to do with me. His manager which was very nice when I talked to him first of week tired to calm his employee down but the guy kept on.
This was awful and very unprofessional I will never be back there and I will continue to let everyone know not to come there. I am still hurt and surprised at how this was handled.

Wish I would have done more research
The store manager contacted me a couple of days ago telling me thay he had no recollectionof the practices of his staff because he had been out of surgery thw last couple of months....unless everyone there is named Chris, then he was one of those who had too much time on his hands.....smh and threatened to file grand larceny charges on me. Seriously??
